Terms of Service

Summary: By using FraudSense you agree to use it lawfully, keep your API key secure, and pay for calls beyond the free tier. We provide the service as-is and are not liable for decisions made based on risk scores.

1. Acceptance of terms

By creating a FraudSense account or using the FraudSense API or SDK ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of service

FraudSense provides a device intelligence API and mobile SDK that analyzes device signals and returns real-time fraud risk scores. The Service is intended to assist clients in making fraud prevention decisions — it does not make decisions autonomously and all final decisions remain with the client.

We target 99.9% uptime for the FraudSense API. Scheduled maintenance will be communicated in advance where possible. We are not liable for losses arising from service unavailability beyond our reasonable control.

Important: FraudSense risk scores are advisory. You are solely responsible for the decisions you make based on risk scores returned by the Service. FraudSense is not liable for losses arising from transactions you allow or block based on our output.

7. Intellectual property

The FraudSense API, SDK, algorithms, documentation, and all related software are the exclusive property of FraudSense and are protected by copyright and trade secret law. Your use of the Service does not grant you any ownership rights.

You retain ownership of your own data and the data of your end users. By using the Service, you grant FraudSense a limited license to process that data solely to provide the Service.

8. Confidentiality

Each party agrees to keep the other's confidential information (including API keys, pricing, and technical specifications) confidential and not to disclose it to third parties without prior written consent.

9. Limitation of liability

To the maximum extent permitted by applicable law, FraudSense shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to FraudSense in the 12 months preceding the claim.

You agree to indemnify and hold harmless FraudSense from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be resolved in the courts of the UAE, unless otherwise agreed in writing for Enterprise clients.

13. Changes to terms

We may update these Terms from time to time. We will notify registered clients by email of material changes with at least 14 days notice. Continued use of the Service after the effective date constitutes acceptance.
